These Terms of Use (“Terms”) govern your access and use of MOCSIMS.COM, its associated usernames “m0therx0fxcha0s” and “Kieram Moon,” and all digital content provided by the Creator (referred to as “Content”). By accessing or using MOCSIMS.COM and its Content, you agree to be bound by these Terms.

The term “Creator” refers to the brand, entity, or Content Creator who owns and operates MOCSIMS.COM, and is represented by the associated usernames “m0therx0fxcha0s” and “Kieram Moon.” The Creator is responsible for creating and providing the digital content described within these Terms.

2. Content

“Content” encompasses all digital creations, including but not limited to mods, builds, and other uploaded digital content, available on MOCSIMS.COM or any other platform owned and operated by the Creator under the associated usernames.

3. License

A personal, non-exclusive, non-transferable, limited right to use the Content is granted to users for personal, non-commercial purposes. This right is subject to compliance with the terms outlined in this document.

4. Derivative Works

“Derivative Works” are modifications, adaptations, or creations based on the original Content.

5. Commercial Exploitation

Involves using the Content for any commercial purposes, including selling or distributing it without express written consent as defined by the Prior Formal Consent Form within these Terms.

6. Prior Formal Consent Form

The “Prior Formal Consent Form” refers to the formal express written consent granted by the Creator upon request for Commercial Exploitation. Users must adhere to the terms outlined in this form, as defined within these Terms.

7. Termination

The action of discontinuing or suspending a user’s access to MOCSIMS.COM, m0therx0fxcha0s, Kieram Moon, or the Content, at the discretion of the Creator as defined within these Terms.

1. Acceptance of Terms
   By accessing or using MOCSIMS.COM, or any platform owned by the Creator, or any digital content provided on these platforms, including mods, builds, and other uploaded digital content (“Content”), you agree to abide by the terms and conditions set forth in this Terms of Use agreement (“TOU”).
   
2.  Ownership and Intellectual Property
   All Content available on MOCSIMS.COM, m0therx0fxcha0s, Kieram Moon, or associated platforms is the intellectual property of MOCSIMS. You acknowledge and agree that MOCSIMS retains all rights, title, and interest in and to the Content, including any modifications or derivative works.
   
3. License
   Subject to your compliance with this TOU, m0therx0fxcha0s grants you a personal, non-exclusive, non-transferable, limited license to use the Content for personal, non-commercial purposes. This license does not grant you the right to sell, distribute, or otherwise commercially exploit the Content without the express written consent of m0therx0fxcha0s.
   
4. Restrictions of Commercial Exploitation
   You agree not to modify, adapt, or create derivative works based on the Content, use the Content for any commercial purpose without obtaining a written “Prior Formal Consent” from m0therx0fxcha0s, distribute, sublicense, or transfer the Content to any third party, and / or remove, alter, or obscure any copyright, trademark, or other proprietary notices from the Content.
   
5. Prior Formal Consent Form
   For any Commercial Exploitation, defined as the use of the Content for commercial purposes, including selling or distributing it, you are required to obtain Prior Formal Consent. The Prior Formal Consent Form is a separate document granting express written consent by the Creator for such commercial use. Users must adhere to the terms specified in the Prior Formal Consent Form.
   
6. Creator’s Reserved Right to Decline Consent for Commercial Exploitation
   The Creator reserves the unconditional right to decline granting Prior Formal Consent for Commercial Exploitation. The Creator may exercise this right at their sole discretion, taking into account various factors, including but not limited to ethical considerations, alignment with the Creator’s brand values, and potential impact on the integrity and reputation of the Content.
   
   In the event that the Creator chooses to decline Prior Formal Consent, the user shall refrain from engaging in any form of Commercial Exploitation as defined in this Agreement. The Creator is not obligated to provide detailed reasons for the decision to decline consent.
   
7. User-Generated Content
   If you create any derivative works or modifications based on the Content, you agree not to claim ownership of such works and acknowledge m0therx0fxcha0s as the original creator with a direct link to the original Content.
   
8. Updates and Support
   m0therx0fxcha0s may provide updates or support for the Content at its discretion. You are encouraged to check for updates regularly. Support is only offered VIA “m0therx0fxcha0s’ mods” Discord Server.
   
9. Termination
   m0therx0fxcha0s reserves the right to terminate or suspend your access to MOCSIMS.COM, m0therx0fxcha0s, Kieram Moon, or the Content at any time, without notice, for any reason.
   
10.  Changes to Terms
    MOCSIMS reserves the right to modify or update this TOU at any time. The date of the latest revision will be posted at the beginning of this document. By accessing MOCSIMS.COM and its Content, you acknowledge and accept the latest version of these Terms of Use. If you do not agree with any part of these Terms, you are not authorized to access or use MOCSIMS.COM or its Content.
